The following Terms of Service are the same ones Journal Community Members are required to read and acknowledge prior to being granted an account here. While you are a visitor of this site, you are expected to adhere to the same Terms of Service. Important identifying information about you is recorded as part of our continued commitment to protect Authors here as well as to assist law enforcement and judicial services personnel around the world as requested.

| The Journal Community is an Adult Journal site. Some of the Entries and Discussions here may be of an adult nature. By law we are required to ask for your birthdate and for a certification that you are of legal age within the country that you presently reside in.
|

By continuing past this point, you are certifying that you are of legal age within the country you presently reside in, and that you are recognized as a legal adult by that country.

We will not back up your journal for you!

You are responsible for backing up your own journal. This includes your entries, your welcome screen, and any notes (responses) you have received to your entries. To facilitate this, we have created a script that will generate a Comma Separated Value File for you and then allow you to download it. USE IT OFTEN! We will not be held responsible for the loss of your journal because you did not back it up.

Q: Why don't you back up our journals?

| A: For a number of reasons, some of them being:
|
- Because we don't own your intellectual works -- you do.
- Because it isn't our responsibility -- it's yours. We're all adults here.
- Because we don't have the means (media, personnel) to ensure a proper backup at the present time.

The Journal Community is a privately run, privately funded (with the help of donations from generous Members (hint, hint!)) journal/blogging website. Use of this site is free of charge to all. Advertisements and Pop-up ads are not presently used. All services provided to you come with no guarantees. We do not make any promises, explicit or implied. Any promises that you might feel have been made in the past, present, or future do not constitue a binding agreement.

Your continued use of this site indicates your agreement that we cannot be held liable for any damage, direct or indirect, that is done to your journal, hardware, software, or connection.

Additionally, should content be deemed illegal by such law having jurisdiction over the user, The Journal Community is committed to submitting all necessary information to the proper authorities.

In Short: USE OF THIS SITE IS AT YOUR OWN RISK!

This is probably the biggest problem seen on sites such as this one, so please read this carefully. Violating this agreement is one of the quickest ways to remove yourself from our site!

It's inevitable: With any large community such as this one, there will be the occasional difference in opinion. Face it -- There will be someone on this site that feels differently than you do on virtually every topic out there.

Not everyone has the same religion, culture, sexual orientation, background, upbringing, or experiences that you do. Please take a second and re-read that line -- then take this into account before holding someone to the same standards that you hold yourself to.

While we encourage diverse viewpoints, we do NOT encourage criticism that attacks a member of our site instead of criticism of their views.

IF you read an entry containing someone's view on a topic that you do not agree with:
DO feel free to use constructive criticism to tell them why you feel that their viewpoint is flawed. If the viewpoint is of a personal nature, leave your comment to them in private -- after all, that's why we give you options on what kind of note you want to leave!
DO NOT leave notes or put entries in your journal that personally attack another member of this site.
DO NOT attack a person's choice of religion, their culture, age, gender, background, upbringing, or sexual orientation. (I'm sure I missed something on this list, because I didn't pay that great of attention in cultural diversity training -- but you get the idea.)
DO NOT use excessive profanity in your comments, especially if it degrades or belittles the member you are writing the comments to.
An example of a good (constructive) criticism: "Dear (abortion supporter/protestor), I do not agree with your viewpoint. Have you considered that [fill in your points here]?"

An example of bad (non-constructive) criticism: "Hey you mo****fu**ing son of a *****, You're a s***id commie..."

... do I need to go on, or do you get the idea? Good.

The Journal Community has a lot of Authors on it, often with many using the site simultaneously. With any large community such as this one, there will be the occasional difference in opinion on what is appropriate and what is not, or what content is legal and what is not. While we encourage you to use your own discretion, we also realize that points may arise that require administrative guidance.

When this occurs, the Site Administrators and/or Journal Moderators will be required to make a discretionary decision on the content in question. Your cooperation and respect for the decision that is made is imperative, even if the decision is not in your favor.

Some Questions we ask when making a decision:
(far from complete, but this will give an idea)
Does the content in question publicly degrade or humiliate another person who is not a public figure?
Does the content in question attack a person's choice of religion or their culture, age, gender, background, upbringing, or sexual orientation?
Does the content in question contain illegal sexual acts such as those involving children, animals, or rape?

Notice: This site is designed for use by Adults only. If you are a teenager, please use another site for your diary needs. You have now been informed and warned, and prior to getting to this section you have agreed that you are of legal age and are considered to be a legal adult in the country you presently live in.

That said ...

First, let me state that I regret that we have to spell this out, but....

This is our "Two Strikes and You're Out!" policy!

Your journal here may contain:
links to adult images
links to adult sounds
adult language
text which may describe adult situations

As a reminder: Within the confines of international and local law, we will not place a limit on the type, or appropriateness of user content within journals. Should content be deemed illegal by such law having jurisdiction over the user, The Journal Community is committed to submitting all necessary information to the proper authorities.

Should any Content be reported to The Journal Community as being offensive or inappropriate, The Journal Community might call upon the author to retract, modify, or protect (by means of private and friends only settings) the Content in question within a reasonable amount of time, as set forth by the The Journal Community staff. Should the author fail to meet such a request from The Journal Community staff, The Journal Community has the full authority to take the following actions:

1st Offense: If the above happens once, a warning will be issued to you by a Journal Moderator or a Site Administrator. Your account will be tagged internally for a period of one (1) year to indicate that we have warned you (You will not lose any site privileges). After (1) year, the warning flag will be expunged (removed) from your account.

2nd Offense: If the above happens again after you have been warned, your account, journal, entries, comments, and preferences will be unceremoniously TERMINATED, and we will take all necessary steps to prevent your return. We are very serious about this point.

In order for this site to maintain it's efficiency standards, we need to remove journals that have not been used for a long time (sometimes called "stale journals").

Please sign in to the site at least once every 90 days. You don't have to write an entry when you sign in -- you just have to show that you've been here!

On day 91, your Journal will be marked PRIVATE. This makes it so that others cannot find your journal, but you can still sign in and change it to another status (such as Public, Friends Only, etc).

On day 180, your Journal will be DELETED and your account will be resigned. This is our way of keeping the database from being clogged up by Journals that are no longer being used. If your journal is deleted, there will be no way for you to recover your entries. (Hint: make regular backups using the backup tool provided!)
